Program Description: This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with Click Midwest through our website at clickmidwest.com, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.
Cancellation Instructions: You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.
Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.
Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.
Age Restriction: You must be 18 years or older to participate in our SMS program.
All website templates, "snapshots," automation workflows, funnels, and proprietary logic provided by Click Midwest are the sole intellectual property of Click Midwest. You are granted a limited, non-transferable, revocable license to use these systems only during the term of an active, paid subscription.
You are responsible for the accuracy of any information you submit through our forms, chat widgets, or surveys. If you provide a phone number or email address, you represent that you are the subscriber or customary user of that account. You agree to notify us immediately if you change or deactivate your contact information to prevent us from inadvertently communicating with a third party.
You agree to defend, indemnify, and hold harmless Click Midwest, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
The services on this site are provided on an "AS IS" basis.
To the fullest extent permitted by law, Click Midwest shall not be liable for any indirect, incidental, or consequential damages (including loss of data or revenue) arising from your use of the site or HighLevel-automated communications.
Our total liability for any claim arising out of these terms shall not exceed the amount paid by you, if any, to access the site during the twelve (12) months prior to the claim.
Termination of Access: Upon cancellation or non-payment, your license to use the Click Midwest platform is revoked. Access to all hosted assets, including but not limited to websites, funnels, and CRM records, will be suspended immediately and scheduled for deletion.
Software Dependency: You acknowledge that websites and automations built on our platform are proprietary to the HighLevel software environment. These assets cannot be "exported" or moved to third-party hosting providers (e.g., WordPress, Wix, or Shopify).
Data Portability & Migration: Upon request within thirty (30) days of termination, we will provide an export of your raw Contact Data (CSV format). If you wish to retain the full website structure and automation workflows, you must: (1) Secure an independent HighLevel software license; and (2) Pay a one-time Sub-Account Transfer Fee of $250.00 to Click Midwest to facilitate the administrative move.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Arbitration: Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in Adair County, Missouri, in accordance with the rules of the American Arbitration Association.
Class Action Waiver: You agree that any arbitration or legal action shall be conducted in your individual capacity only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.
These Terms are governed by the laws of the State of Missouri. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
